Terms of Service (TOS) for Daddy's Plums LLC CRM System

1. Acceptance of Terms

By accessing and using the CRM system provided by Daddy's Plums LLC ("Company"), you ("User") agree to be bound by these Terms of Service ("TOS"). If you do not agree to these terms, you must not use the services provided.

2. Description of Service

The Company provides a Customer Relationship Management (CRM) system that enables Users to manage customer data, sales, and other related functions. The services are provided "as is" without warranty of any kind, either express or implied.

3. Limitation of Liability

Daddy's Plums LLC, its affiliates, partners, and any of their employees, agents, officers, directors, or service providers shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from:

• The use or the inability to use the CRM system or its functions;
• Unauthorized access to or alteration of your transmissions or data;
• Conduct or content of any third party on the service;
• Any other matter relating to the service.

The User expressly agrees that the use of the CRM system is at the User's sole risk. The Company and its partners take no liability for the use of the website or its functions. The User is solely responsible for any damage to their computer system or loss of data that results from the download or use of such material or data.

4. Indemnification

You agree to indemnify and hold Daddy's Plums LLC, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the service, your connection to the service, your violation of the TOS, or your violation of any rights of another.

5. Modifications to Service

The Company reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. You agree that the Company shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.

6. General Information

The TOS constitutes the entire agreement between you and Daddy's Plums LLC and governs your use of the service, superseding any prior agreements between you and Daddy's Plums LLC. The TOS and the relationship between you and Daddy's Plums LLC shall be governed by the laws of the jurisdiction in which the Company is established without regard to its conflict of law provisions.

7. Acknowledgement

By using Daddy's Plums LLC's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

8. Use in Furtherance of a Crime

• Prohibited Use: The User agrees not to use the CRM system for any purposes that are illegal or in furtherance of any criminal activities. The User acknowledges that the CRM system is intended for lawful business purposes only.
• Indemnification for Misuse: The User agrees to indemnify and hold harmless Daddy's Plums LLC, its affiliates, partners, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from or in connection with any use of the CRM system in furtherance of a crime or any illegal activities.
• Cooperation with Law Enforcement: Daddy's Plums LLC reserves the right to cooperate with law enforcement authorities in the investigation of use of the CRM system that is illegal or in furtherance of a crime, including providing User information as required by law or subpoena.
• Termination for Illegal Use: Daddy's Plums LLC reserves the right to terminate or suspend any User's account and access to the CRM system if the Company becomes aware of any use of its services in furtherance of a crime or any illegal activities, without liability or refund.
